Acceptance of Terms

By accessing and using the National Media Group Inc. website and services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services Description

National Media Group Inc. is a data intelligence company that collects, enriches, and delivers structured datasets derived from publicly available government records. Our services include public records data collection, data enrichment, and structured data delivery to verified business clients.

Data Licensing Terms

Data products delivered by National Media Group Inc. are licensed, not sold. By receiving our data products, clients agree to the following:

  • Data may only be used for lawful business purposes
  • Data may not be resold, redistributed, or sublicensed without written permission
  • Clients are solely responsible for ensuring their use of data complies with all applicable federal, state, and local laws, including but not limited to the Telephone Consumer Protection Act (TCPA) and state telemarketing regulations
  • Clients must maintain their own Do Not Call compliance programs when using data for outreach purposes
  • Data is licensed for the specific business purpose agreed upon and may not be used for unrelated purposes

User Responsibilities

When using our website and services, you agree to:

  • Provide accurate and truthful information
  • Use our services only for lawful purposes
  • Not misrepresent your identity or business
  • Respect the intellectual property rights of National Media Group Inc.
  • Not attempt to access unauthorized areas of our systems

Data Accuracy & Warranty Disclaimer

All data and information provided by National Media Group Inc. are furnished “AS IS” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or completeness.

National Media Group Inc. sources data from public government records and publicly available information. While we use commercially reasonable efforts to ensure data quality, we do not warrant or guarantee the absolute accuracy, completeness, or currency of any information provided.

Users of our data services are solely responsible for independently verifying all information and ensuring compliance with all applicable laws before acting on any data received from us.

Intellectual Property

All content on this website, including text, graphics, logos, and software, is the property of National Media Group Inc. and is protected by United States and international copyright laws. Our data enrichment methodologies, scoring algorithms, and delivery systems are proprietary.

Limitation of Liability

National Media Group Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of our services or data products, including but not limited to lost profits, regulatory fines, or legal fees. Our total aggregate liability for any and all claims shall not exceed the lesser of (a) the total amount paid by you to National Media Group Inc. in the twelve (12) months preceding the claim, or (b) $10,000.

Indemnification

You agree to indemnify and hold harmless National Media Group Inc., its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our services, your use of data provided by us, or violation of these terms, including any claims arising from your improper use of licensed data.

Termination

Either party may terminate a data licensing agreement by providing thirty (30) days written notice to the other party. Notice delivered to the email address on file constitutes valid written notice.

Termination for Cause

National Media Group Inc. reserves the right to terminate any data licensing agreement immediately and without prior notice if a client:

  • Violates any applicable federal or state law, including but not limited to the Telephone Consumer Protection Act (TCPA) or Do Not Call regulations
  • Resells, redistributes, or sublicenses any data delivered under the agreement
  • Provides false or misleading information during the client vetting process
  • Engages in fraudulent payment disputes or chargebacks

Effect of Termination

Upon termination for any reason: (a) all territory exclusivity rights granted to the client are immediately released and become available for reassignment; (b) delivery of new data ceases on the termination date; (c) client may continue using previously delivered data for active outreach purposes for ninety (90) days following the termination date, after which all licensed data must be destroyed or deleted; (d) all outstanding balances become immediately due and payable.

Prepaid Fees

Fees paid for service periods already delivered are non-refundable. National Media Group Inc. has no obligation to refund any portion of a prepaid billing period upon termination.

Dispute Resolution

Any dispute arising out of or relating to these Terms or the services provided shall first be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved within thirty (30) days of written notice, either party may pursue binding arbitration administered under the rules of the American Arbitration Association (AAA), with arbitration conducted in Kenosha County, Wisconsin.

The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction. Each party shall bear its own costs and fees related to arbitration, unless the arbitrator determines otherwise. Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property or confidential information.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms of Service. For material changes that affect your rights or obligations, we will provide at least thirty (30) days' notice by posting the updated terms on this page and, where possible, notifying active clients by email.

Non-material changes (such as corrections or clarifications) may take effect immediately upon posting. Your continued use of our services following the effective date of any changes constitutes acceptance of those changes. If you do not agree with the revised terms, you may terminate your arrangement in accordance with the Termination section above.
